试分析下列出口贸易合同的索赔条款,指出其中错误或不合理的地方: (1)品质异议货到目的地口岸之日起30天内提出,数量异议货到目的地口岸之日起15天内提出,买方仅需提供当地检验机构的检验证明。卖方将根据具体情况解决异议。由自然原因或船方、保险商责任造成的损失,卖方将不予考虑任何索赔。信用证未在合同之指定日期到达卖方,在FOB条款下,买方未按时派船到指定港口,或信用证与合同条款不符,买方未在接到卖方通知所规定的期限内电改有关条款时,卖方有权提出索赔,撤销合同或延迟交货。 ( 2 ) 卖方如不能按合同规定如期交货,并同意支付罚金,买方可同意延期交货,付款银行相应减少议定的支付金额,但罚款不得超过迟交货物总额的150%。卖方如逾期10个星期仍不能交货,买方有权撤销本合同。尽管合同已撤销,但卖方仍应如期支付上述罚金。
