2009年,22岁的在校大学生看着周围的同学都有电脑,自己也心动了,便想买台笔记本电脑。经与家人协商后 ,决定网购。最终,在网上看中了一款惠普电脑,在与卖家商讨价格与交付方式后,买下了这台电脑。 但在付款四天后收到电脑打开一看,心里有点失落。原来,他没想到电脑的屏幕会这么小,和卖家联系调货,卖家当即答应,但要求他自己负担运费。于是,在收货第二天,到某物流公司,自己填单、将电脑寄给卖家。 没想到,过了几天,卖家给打来电话称自己收到的是个空箱子,里面没有电脑。卖家的电话让吓了一跳,他立即跑到物流公司去问情况,物流矢口否认自己有责任,称对方已经验货签单了,他们没有任何责任。 回去后又给卖家打电话,让其将空箱寄回。收到空箱后,发现箱子上贴的单据和自己的发货原不同,且卖家还告诉他收到货物时发现箱子明显有二次粘贴痕迹。拿着单据再次找到物流公司要求索赔,但物流公司依旧否认自己有责任,无奈之下,将物流公司告上法庭。 请分析: 和物流公司之间的合同属于何种合同?双方具有什么样的权利义务?
