我国某工程承包公司于2014年5月3日向意大利商人询问钢材的价格,在中,我国工程承包公司声明:要求对方报价是为了计算一项大楼的价格以决定是否参加招标。我国工程承包公司如果参加投标项会2014年5月15日向招标人递交投标书,招标人开标日期为2014年5月31日。2014年5月6日,意大利商人向我方发盘报钢材价格,我国工程承包公司据此计算标价,并于2014年5月15日向招标人递交了投标书,由于国际市场钢材价格上涨。2014年5月21日,意大利商人来电要求撤销其5月6日的发盘。我国工程承包公司当即表示不同意撤销发盘。于是双方为能否撤销发盘产生争议。5月31日,招标人开标,我方工程承包公司中标,随即向意大利商人发出接受通知。但意大利商人坚持发盘已于2014年5月21日撤销,合同不成立。对此,双方争执不下,于是建议仲裁。
